Terms of service for Tidelist and Pro

Updated

Draft: this text waits for approval by the company or its lawyer and is not final.

These terms apply to the Tidelist plugin, the Tidelist Pro add-on, the licence and update service, and the website tidelist.app. They are a draft that the company and its lawyer have not approved yet.

1. Who we are

The seller is Hawk Minds Ltd. (Хоук Майндс ООД), company number 205119042, VAT ID BG205119042, 19a Pushkin Str., Velingrad, Bulgaria (“we”). Contact: [email protected].

2. Software licence

The code of the Tidelist plugin and of the Tidelist Pro add-on is licensed under the GNU General Public License, version 2 or later, like WordPress. You may use, study, change and share the code under that licence.

The licence key, the update service, the licence server and support are services we provide. The name Tidelist and its logo are trademarks of Hawk Minds Ltd. The GPL does not give you the right to use them to sell or promote a product.

3. Tidelist Pro: subscription and price

  • Tidelist Pro is a yearly subscription. The plan decides on how many live sites you can use the key (1, 3 or 10).
  • Prices are shown in euro without VAT. VAT is added at checkout according to your country and, for businesses in the EU, your VAT ID.
  • The subscription renews every year until you cancel. You can cancel at any time in your account. A cancelled subscription ends at the end of the period you paid for.
  • Payments are processed by Stripe. We do not see or store your card number.

4. What the licence includes

  • You may activate the key on as many live sites as your plan allows. Local and staging sites do not count.
  • During the subscription you receive updates and e-mail support.
  • When the subscription ends, the Pro features on sites that already use them keep working. Updates released after the end date and support stop. You can renew at any time.

5. Withdrawal and refunds

You have a 14-day money-back guarantee on every Pro purchase. Details are in the refund policy.

If you buy as a consumer, you have a statutory right to withdraw from a distance contract within 14 days. When you ask for immediate delivery of digital content, you agree that the licence is delivered at once and, in that case, you accept that the statutory right of withdrawal may be lost once delivery has begun. We show this at checkout and ask you to confirm it. Our money-back guarantee applies in addition.

6. Your responsibilities

  • You are responsible for the content of your adverts and for following the terms of OLX and of any other marketplace you connect.
  • OLX approves each developer application. We cannot promise that OLX approves yours or keeps it approved.
  • You are responsible for your OLX account, including its limits and any fees OLX charges.
  • Tidelist never buys packages or pays OLX on your behalf.
  • Do not share your licence key publicly, and do not use the key on more live sites than your plan allows.

7. Not affiliated with OLX

Tidelist is not made, endorsed or sponsored by OLX Group. OLX and WooCommerce are trademarks of their owners.

8. Warranty and liability

The software is provided as it is. We take care to test it, but we cannot promise that it is free of errors or that a marketplace will accept every advert. To the extent the law allows, our liability for any claim relating to Tidelist is limited to the fees you paid in the 12 months before the claim. This does not limit liability that cannot be limited by law, for example for intent or for death or personal injury.

9. Personal data

How we handle personal data is described in the privacy policy.

10. Changes and termination

We may change these terms for future purchases and will publish the new text with its date. We may end a licence that is used against these terms, for example a key shared publicly, after a warning.

11. Governing law

Bulgarian law applies. Consumers keep the protection of the mandatory rules of their country of residence. Disputes go to the competent court in Bulgaria, unless mandatory law gives you another court.
